BESMANI – TERMS & CONDITIONS

These Terms & Conditions (“Terms”) govern your access to and use of the Besmani platform, including Besmani.com, Beauty.Besmani.com, and any related websites, applications, features, or services (collectively, the “Platform”).
By accessing or using the Platform, you agree to be bound by these Terms.

1. PLATFORM ROLE & SCOPE

Besmani operates as a technology and marketplace platform that enables users to browse, discover, request, and interact with services, products, providers, and Besmani-owned services.
Unless explicitly stated in a separate written agreement:

• Besmani does not provide third-party services directly
• Besmani does not act as an employer, agent, partner, or guarantor of independent providers
• Providers and users interact at their own discretion and responsibility

Besmani reserves the right to modify, suspend, or discontinue any part of the Platform at any time.

2. ELIGIBILITY & ACCOUNT REGISTRATION

To use the Platform, you must:

• Be at least 18 years old
• Have the legal capacity to enter into binding agreements
• Provide accurate, complete, and current information

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity conducted under your account

Besmani is not responsible for unauthorized access resulting from your failure to secure your account.

3. USER OBLIGATIONS & CONDUCT

By using the Platform, you agree to:

• Use the Platform lawfully and in good faith
• Provide accurate information when placing orders or requests
• Communicate respectfully with providers and Besmani
• Comply with applicable laws, regulations, and platform rules

You agree not to misuse the Platform, interfere with its operation, or attempt to access restricted systems or data.

4. MARKETPLACE DISCLAIMER

The Platform may list or promote services and products offered by independent third-party providers.
You acknowledge that:

• Providers are solely responsible for their services and products
• Besmani does not guarantee service quality, availability, or outcomes
• Any agreements between users and providers are independent of Besmani

Besmani may assist with communication or dispute facilitation but is not responsible for resolving third-party disputes.

5. PAYMENTS, PRICING & BILLING

5.1 Payment Availability
Online payment may not be available for all services. Payments may be completed using approved methods such as:

• Phone payment
• Check
• Other offline or approved methods

5.2 Pricing
All prices displayed are subject to change. Final pricing is confirmed at checkout or in a written agreement.

5.3 Installments & Payment Plans
Some services may allow installment or milestone-based payments. If selected:

• The total payment must equal 100% of the agreed amount
• Payments may be tied to specific project stages
• Services may pause if a payment is late or unpaid

5.4 Authorization
By submitting an order or payment plan, you authorize Besmani or the applicable provider to issue invoices and collect payments according to the agreed terms.

6. CANCELLATIONS & REFUNDS

6.1 Cancellations
Cancellation policies may vary by service and will be disclosed before confirmation.
If work has already started, completed portions may be non-refundable.

6.2 Refunds
Unless otherwise stated in writing:

• Fees for completed work are non-refundable
• Platform or administrative fees may be non-refundable
• Approved refunds are issued at Besmani’s discretion

6.3 Disputes & Chargebacks
You agree to contact Besmani first regarding billing concerns. Unauthorized chargebacks may result in account suspension or termination.

7. CONTENT, REVIEWS & COMMUNICATION

Users may submit reviews, feedback, or other content. You agree that:

• Content must be truthful, respectful, and lawful
• Besmani may moderate, remove, or restrict content at its discretion

You grant Besmani a non-exclusive right to display submitted content on the Platform.
Harassment, false reviews, or abusive conduct is prohibited.

8. ACCEPTABLE USE POLICY

You may not:

• Use the Platform for illegal, deceptive, or fraudulent activities
• Upload malicious code or attempt to disrupt services
• Harass, impersonate, or exploit other users or providers

Violations may result in immediate action, including suspension or termination.

9. SUSPENSION & TERMINATION

9.1 Right to Act
Besmani may suspend or terminate your account, with or without notice, if you:

• Violate these Terms
• Fail to pay required fees
• Engage in fraudulent, abusive, or unlawful conduct
• Misrepresent information or intent
• Repeatedly misuse the Platform

9.2 Suspension
Suspension may include:

• Restricted access to features
• Removal of listings or orders
• Temporary pause of services

9.3 Termination
Termination may result in:

• Permanent loss of access
• Removal of content or data
• Forfeiture of ongoing services

9.4 Effect of Termination
All outstanding obligations, including payment responsibilities, survive termination.

10. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

• Besmani is not liable for indirect, incidental, or consequential damages
• Besmani does not guarantee business success or outcomes
• Liability is limited to the amount paid to Besmani, if any, for the applicable service

11. CHANGES TO TERMS

Besmani may update these Terms at any time.
Continued use of the Platform after changes constitutes acceptance of the updated Terms.

12. GOVERNING LAW & JURISDICTION

These Terms apply to users worldwide and are governed by the laws of the State of California, United States, without regard to conflict of law principles.

Any disputes shall be resolved in the state or federal courts located in California, unless otherwise agreed in writing.
